Signs - A Deterrent for Illegally Parked Vehicles
Posted signs are an excellent deterrent (as well as a requirement for most business situations).
“Tow-Away-Zone” signage, along with the name of the towing company printed on the sign, informs would-be illegal parkers that you are already aware of a parking issue and have taken steps to correct the situation.
A combination of proper signage along with your own security cameras are generally enough of a deterrent to drastically reduce the number of illegally parked vehicles on your property. Signage Rules & Exceptions
In Florida, towing laws are defined by Florida Statute §715.07. Laws regarding proper signage are defined as well.
Here are the situations in which you can have a vehicle towed without the owner’s consent WITHOUT proper signage:
- If the vehicle is illegally parked at a single family residence.
- If verbal or personal notice has already been given to the owner or legal driver of the vehicle.
- If the vehicle is restricting normal operation of your business.
- If the vehicle is blocking a private driveway.
Laws About Tow Away Zone Signage
If you don’t fall into one of the exceptions above, you’ll need proper signage in order to legally have a vehicle towed off of your parking lot or parking area without the owner’s consent.
Proper tow away signage consists of the following:
- The notice must be prominently placed at each driveway access or curb cut allowing vehicular access to the property, within 5 feet from the public right-of-way line. If there are no curbs or access barriers, the signs must be posted not less than one sign for each 25 feet of lot frontage.
- “Unauthorized vehicles will be towed at the owner’s expense” must be displayed in light reflective letters at lest 2 inches tall on a contrasting background. “Tow-away zone” must be visible on the sign in 4-inch tall (or larger) letters.
- The notice must also provide the name and current telephone number of the towing company removing the vehicle.
- The sign structure containing the required notices must be permanently installed with the words “tow-away zone” between 3 feet and 6 feet from ground level.
- The sign must be on the property for at least one full day (24 hours) prior to the removal of any vehicle or vessel.
- Permitting may be required prior to sign installation.
Vehicle Owner Rights
Towing a vehicle without the owner’s consent involves signage specifications that must be upheld in order to legally remove the vehicle from the premises. These laws are designed to ensure that private parking spaces are clearly marked. The individual parking their vehicle should be aware of the potential consequences, in order to give them an opportunity to make a better decision.
The vehicle owner also has the right to information about their vehicle; which company towed their vehicle, where it is being stored, and what fees to expect. Cape Coral Towing & Recovery contacts the local police department or sheriff within 30 minutes of the tow and provides them with all required information.
When a vehicle owner notices their car is missing, they should be able to quickly and easily locate the contact information of the towing service (from the signage) and the trucks and towing equipment must also prominently display the company name, address and contact phone number.
